In a complaint by Dr.
Swapan Dey (CEO of a dialysis hospital) alleging that Vifor International's licensing, pricing and supply practices for its patented drug Ferric Carboxymaltose amounted to abuse of dominance under Sections 3 and 4 of the Competition Act, the NCLAT had held that the Patents Act, 1970 operates as a complete code excluding the Competition Act, so the CCI lacked jurisdiction to examine conduct arising from the exercise of patent rights. The Supreme Court stayed this NCLAT finding, holding that whether the CCI can exercise jurisdiction over anti-competitive conduct that arises from the exercise of patent rights is a question requiring authoritative determination, and confined the appeal to that jurisdictional question alone.
