The Maharashtra Real Estate Appellate Tribunal has upheld a penalty equal to 2% of the project cost against the promoters of the 'RA Residences' project in Dadar East, Mumbai, for utilising additional Floor Space Index on the commercial component of the project without the allottees' prior informed consent, and has directed the promoters to execute conveyance within 60 days.
The RA Residences Co-operative Housing Society had approached MahaRERA alleging that the promoters, RA Associates, materially altered the sanctioned building plans by using additional FSI for the project's commercial component without obtaining the allottees' consent, and had failed to execute conveyance of the property in the society's favour.
In Appeal No. AT06/00804/2025, decided on 16 September 2026, MahaREAT upheld the penalty against RA Associates and its partners for the unconsented FSI increase, and directed the promoters to execute conveyance of the residential building and hand over the common areas and remaining guest parking to the society within 60 days. The Tribunal rejected the promoters' plea that conveyance could be deferred pending a possible future acquisition of additional FSI or transfer of development rights.
