Justice Jyoti Singh of the Delhi High Court has granted an ex parte ad interim injunction restraining Aurore Life Sciences from manufacturing or selling pharmaceutical products containing Ruxolitinib, the active ingredient in the Incyte/Novartis group's cancer and blood-disorder drug marketed as JAKAVI.
The Court held that the plaintiffs had made out a prima facie case of infringement of a valid, unexpired patent — set to remain in force until December 2026 — and that the balance of convenience and risk of irreparable injury favoured the patentee, particularly since the defendant had not yet commercially launched its own product at the time of the order.
The ruling reinforces Indian courts' willingness to grant early, ex parte injunctions in pharmaceutical patent disputes where a generic manufacturer has not yet launched commercially, a significant signal for both originator and generic companies as they plan the timing of pre-expiry product launches around an active, unexpired patent.
