What You Need to Know

Frequently Asked Questions

Within how many days must a buyer pay an MSME supplier?

Within the period agreed between the parties, and in any event within 45 days from the date of acceptance or deemed acceptance of the goods or services, under Section 15 of the MSMED Act, 2006.

Does the buyer have to agree to pay interest for Section 16 to apply?

No. Section 16's compound interest, at three times the RBI's notified Bank Rate, accrues automatically by operation of law once payment is delayed beyond the Section 15 period, regardless of what the underlying contract says.

What can a supplier do if a buyer simply refuses to pay?

The supplier can file a reference before the Micro and Small Enterprise Facilitation Council (MSEFC), which first attempts conciliation and, failing that, refers the dispute to arbitration, with a target of deciding the reference within 90 days.
