Common Grounds for Repudiation

Insurers typically repudiate claims on grounds such as an alleged material non-disclosure at the time of policy issuance, a claimed breach of a policy condition, or a dispute over whether the loss actually falls within the scope of coverage. Not every repudiation is legally sound. Some rest on technical grounds that do not withstand scrutiny once the underlying facts are examined.

When Repudiation May Amount to Deficiency in Service

A repudiation can amount to deficiency in service where it is made without a genuine inquiry into the loss, particularly where the insurer's own surveyor or investigator has assessed the loss as broadly consistent with the claim. Repudiating a claim on a minor documentary discrepancy, without engaging with the surveyor's own findings, is a recurring pattern consumer forums have scrutinised closely.

The Distinction With Established Fraud

Where fraud in the claim is genuinely established, Indian courts have consistently held that no relief, not even partial. Is available to the insured. This is different from a repudiation based on a technical or interpretive dispute about the policy, where the insured retains a real prospect of successfully challenging the repudiation.

Steps to Take After a Repudiation

A policyholder should obtain a copy of the repudiation letter setting out the specific ground relied upon, request a copy of the surveyor's or investigator's report if one was commissioned, and compare the two for consistency. Where the surveyor's findings support the claim but the repudiation letter cites an unrelated technicality, this inconsistency is often the strongest basis for a subsequent complaint.

Choosing a Forum

A policyholder can escalate through the insurer's internal grievance mechanism, approach the Insurance Ombudsman for certain categories of disputes, or file a consumer complaint before the appropriate forum based on claim value. These routes are not mutually exclusive at every stage, though a policyholder should be mindful of limitation periods when deciding how long to pursue internal escalation before filing formally.

Frequently Asked Questions

Can I still get relief if my insurer's surveyor recommended payment but the claim was repudiated anyway?

This inconsistency is often strong evidence in a consumer complaint, though the outcome depends on the full facts and the specific ground cited for repudiation.

What if fraud is alleged against me?

Where fraud is genuinely established, courts have held no relief is available, even partial. So it is important to address any fraud allegation directly and with full supporting evidence, not only the repudiation ground.

Is there a time limit to challenge a repudiation?

Yes. A consumer complaint must generally be filed within two years from when the cause of action arose, which is typically the date of repudiation, so it is advisable not to delay unnecessarily.

Do I need the insurer's surveyor report to file a complaint?

It is not mandatory, but obtaining it (through a request to the insurer or during proceedings) often materially strengthens the case where the surveyor's assessment differs from the ground for repudiation.
