Hospital Bills: The Right to an Itemised Bill and Disputing Overcharging

An explainer on a patient's right to a transparent, itemised hospital bill, how overcharging disputes are raised before consumer commissions and why a general consent form does not settle charges.

About this article: A general explainer prepared by S&S Co. Advocates & Solicitors on a recurring type of dispute. It does not report a specific judgment or order, names no parties and gives no case citation, so it should not be cited as authority. Law and practice change; please verify against the current statute and primary sources before relying on it.

Treatment at a private hospital is a service, and a patient or family who believes they were overcharged can complain of deficiency in service under the Consumer Protection Act, 2019. Hospitals are also subject to patient-rights standards, including the NHRC's Charter of Patients' Rights and, in states where it applies, the Clinical Establishments Act, 2010, which call for transparency about charges.

A consolidated bill that does not break down procedures, medicines, consumables and room charges makes it hard for a patient to check what has been billed. Consumer commissions have treated lack of transparency as a relevant factor, and a general consent to charges signed at admission does not generally cover charges that are inconsistent with the treatment record, such as a higher room category than the one occupied.

Hospital records, such as the discharge summary, bed-allocation record and treatment chart, are commonly the best evidence in such disputes. Relief usually takes the form of a refund of the disputed amount, sometimes with compensation. Disputes about the reasonableness of the medical fees themselves are harder to establish than a discrepancy between the bill and the records.
