A practical guide for an employer facing (or wanting to understand the risk of) an EPFO inquiry under Section 7A of the EPF Act, covering when such an inquiry can be initiated, the procedural safeguards EPFO's own guidelines require, and how an employer should respond.

What You Need to Know

Frequently Asked Questions

On what grounds can EPFO open a Section 7A inquiry?

EPFO's own guidelines confine it to two grounds: a dispute over whether the Act applies to the establishment at all, and determination of the adequacy of dues from an employer.

What makes a Section 7A notice invalid?

A notice issued without a computer-generated diary number through EPFO's compliance e-proceedings portal is treated as non est and does not validly initiate the inquiry.

Can EPFO expand the inquiry's scope after it has started?

No: once initiated, the issues and default period specified in the notice cannot later be expanded, and document requests must stay reasonably confined to that specified scope.

References & Further Reading

This guide references the following statutes, rules and sources, cross-checked at the time of writing.

  1. Section 7A's two permissible grounds for inquiry (applicability dispute; adequacy of dues) and the prima facie case threshold: confirmed via PSA Legal Counsellors' and AZB Partners' Section 7A guidance at research time, reflecting EPFO's February 2020 guidelines
  2. Mandatory computer-generated diary number requirement, with a notice lacking one being non est: confirmed via Khaitan & Co.'s and Greythr's coverage of the EPFO circular at research time
  3. Scope-limitation on later expanding the inquiry's issues or period once initiated: confirmed via the same EPFO guidelines coverage at research time: verify no subsequent EPFO circular has modified these 2020 guidelines before drafting
